Fair Work Australia has ordered Patrick workers who are members of the Maritime Union of Australia (MUA) to stop industrial action at Port Botany.
Patrick staff employed at the port whose employment is subject to the Patrick Terminals Extended Certified Agreement 2008 must not engage in any unprotected industrial action, according to an order handed down by FWA president Graeme Watson.
FWA’s order, called the Patrick Stevedores Holdings Port Botany Industrial Action Order No. 1 2012, has been issued under section 418 of the Act.
MUA must “immediately stop organising any unprotected industrial action involving any of the Port Botany employees,” the order said.
Patrick staff at Port Botany must “immediately stop engaging in, or threatening to engage in, unprotected industrial action.”
FWA’s order was effective from 6pm on Wednesday March 14 and is in force until June 14.
In a statement released today, Patrick claimed that the unprotected activity in the form of a “go slow” at Patrick’s Port Botany container facility has caused a 30% loss of productivity.
